Due to the commonality of electronic records and increased raw data in the workplace, changes to the Federal Rules of Civil Procedure in December 2006 increased pressure for companies to manage electronically-stored information (ESI) in support of the electronic discovery process.  Not only is it mandatory that companies adhere to e-records retention and data destruction policies, organizations must also assure compliance of its policies regarding retention of hard drives and backup tapes of its applications servers, especially email servers.


Increasingly, companies and outside counsel are being held accountable for deficient collection and production efforts during the discovery process, and discovery of ESI is now part of routine civil cases.
